Terms of Service Agreement
By signing up for the FastMath online course (“Online Course”) or any FastMath online service, or web site, you are agreeing to be bound by the following terms and conditions (“Terms of Service Agreement”).
This Terms of Service Agreement is a binding legal contract between you and Fast Education Group, LLC (doing business as “FastMath”, and may be referred to as “we,” “us,” or “our”), regarding your use of the FastMath website located at www.fastmath.net and online courses and course materials hosted on Thinkific at fastmath.thinkific.com and/or courses.fastmath.net, on the blog site medium (www.medium.com) and other web sites (collectively, these resources are referred to as the “FastMath Websites”).
Online courses using the FastMath brand name are hosted on Thinkific or other course platforms and which may consist of video, audio, PDF documents, spreadsheets, web pages, multimedia, online quizzes and assessments, and other learning materials will referred to as "FastMath Online Courses." FastMath Online Courses, FastMath Websites, and other services delivered over the Internet (such as mobile applications), will be collectively referred to as FastMath Online Services. Any new features, tools, or resources created in the future and are included in either FastMath Online Courses or FastMath Online Services shall be also subject to these Terms of Service.
We reserve the right to update and change the Terms of Service by posting updates and changes to the FastMath Web Sites or Online Courses. We will notify users about important changes to the Terms of Service via email. You agree that if you use FastMath Online Services after being notified of changes to the Terms of Service, that you are accepting the new Terms of Service. To use FastMath Online Services in the future, after being notified about changes to the Terms of Service governing the FastMath Online Services, you must accept the new Terms of Service. If you do not accept the new Terms of Service, you agree to discontinue use of FastMath Online Services.
Carefully read this Agreement before using the FastMath Websites. By using this Website, you agree to the terms and conditions of this Agreement. If you do not agree to any of these terms, do not use the FastMath Websites or Online Services and do not enroll in any FastMath Online Course.
Definition: Course Materials
The content and materials which constitute FastMath Online Courses (referred to as “Course Materials") include, but are not limited to, the following: the expression, explanations, description and language used for the calculation methods and algorithms included in the course, the methods and concepts covered in the course; the graphical representations of calculation algorithms, procedures, and problems; the examples, practice problems, and solution methods included in the course; the specific numerical properties of these examples, and practice problems; the diagrams, figures and other visual aids included in the course; language, context-specific terminology, and other stylistic elements of the course content; editorial choices about which methods, concepts, examples, diagrams, and practice problems to include; and the sequencing of all of the course content and elements. The term Course Materials applies to the above elements in all media included in the FastMath Online Courses, including videos, audio narration, PDF files, spreadsheet files, web pages, text files, Word and Pages documents, and other downloadable or viewable content and media.
Terms and Conditions for use of FastMath Website, Online Courses, and Online Services
Matthew Tambiah hereby grants you a revocable, non-transferable, and non-exclusive permission to access and use the FastMath Website and Online Courses set forth in this Agreement, provided that you accept all of the following:
Fast Education Group, LLC hereby grants you a revocable, non-transferable, and non-exclusive permission to access and use the FastMath Website and Online Courses set forth in this Agreement, provided that you accept all of the following:
- You affirm that you are either more than 18 years of age, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in this Agreement, and to abide by and comply with this Agreement. If you are unable or not competent to enter into contracts you do not have authorization to enroll in FastMath Online Courses.
- You agree to use your legal name as registration, and provide a valid email address that you have access to in order to receive login information and other information regarding use of the FastMath Websites and Online Courses.
- You agree to allow FastMath to contact you with information regarding use of the FastMath Websites and Online Courses, and new features and services available.
- You agree that you will not replicate, copy, or distribute any portion of Course Materials to others. You agree you will not communicate any portion or aspect of the Course Materials to others in written, verbal, visual, or graphical format either physically or electronically. You agree that you will not publish or communicate any portion of the Course Content and/or Materials in any medium in a public or private forum including, but not limited to, a web site, webinar, video or audio stream or media file, blog or Internet forum post lecture, workshop, conference, presentation, or lesson. You agree not to make Public Performances of Course Materials. You agree not to sell, resell, trade, or exchange Course Materials or knowledge of Course Materials for financial, monetary, or other type of benefit. You agree that you will not communicate to others the topics covered in FastMath Course Materials beyond the purpose of what the FastMath courses are designed to prepare students for.
- You agree that you are not in the process of writing, creating, producing or financing the production of math, quantitative or technical educational materials or services, and you assert that you are not acting as an agent or on behalf of somebody who is creating, producing, or financing math, quantitative or technical education materials or services. You agree that you do not have plans or intentions to write, create, produce or finance the production of math, quantitative or technical educational materials or services, and that you will not engage in any of these activities in the future.
- You agree that you are not an investor or owner, or employee of an investment firm that influences or controls the operational or strategic decisions of entities (companies, organizations, or individuals) that create educational resources. If you are working at an investment firm, the firm must make passive investments, such as a mutual fund, and not influence operational aspects of the companies invested in. If you are an investor or employee in a company that in the future takes an active role influencing operational aspects of a company in the educational space, you agree to recuse yourself of all decisions and advice regarding such an educational company. You also agree to recuse yourself of any discussions with, or evaluations of investments of companies who create math or science educational resources, or companies that a reasonable person would expect would create math or science educational resources in the future. regarding investment.
- You agree you will not communicate any aspect of The Course Materials to a person who has the intention of, or to a person who a reasonable person would conclude has the intention, or is likely to have the intention of, writing, creating, producing or financing math educational products and/or services.
- You agree to not use any Course Materials as a reference or resource to write, create, or produce math, quantitative or technical educational resources; and you agree to not use any Course Materials in any future resources, products, or services which you create or are in any way involved in the creation or production of. You agree to not create Derivative Works of the Course Content and/or Materials in future.
You agree that any Derivative Works of FastMath resources that you create and which are distributed to others publicly or privately become the Intellectual Property of Matthew A. Tambiah. These forms of Intellectual Property include, but are not limited to, Copyright, Design Registrations and Design Patents (US), Utility Patents, Trademarks, and Trade Secrets.
In the event that you share FastMath resources with another party you agree to inform them of the FastMath Terms of Service. - You agree not to share your password with other persons or groups of people, or organizations. Use of the FastMath Websites is for your personal use only.
- You agree not to use or launch any automated system, or provide your login credentials to the FastMath Website or Online Courses to such a system, including without limitation, “robots,” “spiders,” or “offline readers,” that accesses the Website in a manner that sends more request messages to the FastMath Online services or courses in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser. You agree not to collect or harvest any personally identifiable information from the FastMath Websites, nor to use the communication systems provided by the FastMath Websites \ for any commercial solicitation purposes. You agree not to solicit, for commercial purposes, any users of the FastMath Websites with respect to their User Submissions.
- You agree to ensure that any person who accesses or views the Course Materials under your personal license reads and understands of the FastMath Terms of Service. You agree that it is your sole responsibility to ensure they do so, and that you will make best effort and all reasonable effort to abide by these Terms of Service and to ensure that any person accessing The Course Materials under your personal license reads and understands the FastMath Terms of Service. You accept financial liability for damages if a person who access the FastMath Websites and Online Courses using using your username and password or Account, and then discloses Course Materials broadly, or uses FastMath Materials to create another educational product or service.
- You acknowledge that the Course Materials on the FastMath Websites, including without limitation, the text, software, scripts, graphics, files, documents, images, photos, sounds, music, pictures, messages, interactive features, the design of and “look and feel,” and the like (“Course Materials”) and the trademarks, service marks and logos contained therein (“Marks”), are owned by Fast Educational Group, LLC, subject to copyright and other intellectual property rights under the law, and this Terms of Service. Content on the Website is provided to you AS IS for your information and personal use only and may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners. Fast Education Group, LLC reserves all rights not expressly granted in and to the Website and the Course Materials.
- You agree not to circumvent, disable, or otherwise interfere with security-related features of the FastMath Websites or features that prevent or restrict use or copying of any Course Materials or enforce limitations on use of the FastMath Website or the Course Materials therein.
Confidentiality and Non-disclosure Agreement
- You agree and accept that Course Materials and information, calculation methods, formulas, diagrams, and topics covered in FastMath Online Services, as well of the sequencing of content and editorial and stylistic aspects of Course Materials are Trade Secrets and you agree to keep such information Confidential. As a user or paying customer of FastMath Online Services you have permission to view Course Materials for your personal use. You agree to take necessary measures to keep Course Materials Confidential as Trade Secrets.
By accepting these Terms of Service you are accepting a Non-Disclosure Agreement whereby you agree no to disclose information about FastMath materials to other people, organizations, or business entities, or to publish information about FastMath materials in any physical or electronic medium. You agree not to disclose calculation methods, formulas, diagrams, or topics covered in FastMath Online Services, and you agree not to disclose the sequencing of content and editorial and stylistic aspects of FastMath Course Materials
Disclosing Trade Secrets to unauthorized parties is considered theft of Trade Secrets and has both criminal and civil consequences, as does receiving stolen Trade Secrets. If you dispute that Course Materials are Trade Secrets or believe Course Materials that are part of a commercial offering cannot be Trade Secrets, then you must discontinue use of FastMath Online Services. You agree not to make legal challenges to the claim that Course Materials are Trade Secrets in any legal jurisdiction. - You agree to provide proof of identity if requested by a FastMath employee or representative in order to continue using FastMath Online Services. You agree to provide a link to your LinkedIn profile, proof of student or employment status, or photographs of valid government issued identification such as a drivers license, national ID, or Passport if requested. Failure to provide this information may result in suspension of access to FastMath Online Services and Courses. Response to verification requests may take up to two business days.
End users who refuse to provide the necessary information for Identity Verification or provide insufficient information to verify identity and employment or student status will be refunded except for 6% of the purchase price to cover transaction costs which are not refunded by the payment processors used by FastMath Online Services. - Fast Education Group, LLC reserves the right to discontinue services for any customer who fails to provide proof of identity when requested, or to any customer who our analysis indicates may be acting with malicious intent, or intent to distribute FastMath materials in an unauthorized manner. If services are discontinued, refunds will be available through the FastMath Refund Policy.
- Fast Education Group, LLC reserves the right to suspend access to Course Materials to review a customers identify and verify they are abiding by the FastMath Terms of Service. If the suspension is lifted, subscription lengths will be extended by the amount of time that access was suspended.
- FastMath reserves the right to refuse service to any customer who we believe may violate the Terms of Service or is likely to disclose FastMath materials to others.
- You agree not to use the Course Contents and Materials in any commercial setting, which includes, but is not limited to, the inclusion of any portion of the Course Materials in any commercial product or service (whether public or private), using any portion of Course Materials to attract customers for or to promote another commercial product or service, or using any portion of Course Materials to to generate revenue from advertisements.
- You agree that the Confidential and Non-Disclosure agreement applies to any content delivered by FastMath representatives or employees (including Matthew Tambiah) to you in person or via electronic means outside of FastMath online courses or web services, including, but not limited to, through email, phone call, Internet voice call software, text or messaging application, and video conference (including tools from Skype, Zoom, Google, Microsoft, Apple, and other companies). Such content, information and concepts will be referred to as "FastMath Material". You agree to keep all FastMath material Confidential and will not disclose it to other parties, or use it in creating your own education resources, or pass it to other parties who may use it in their educational resources, either free or commercial (paid) educational resources.
- You agree that you will not commercialize material from FastMath resources in any way. You may use FastMath resources and concepts in your work, but you agree not to use information and from FastMath resources to advise educational clients (if you are a consultant), and not pass information from FastMath resources on to others, either as part of a commercial offering or service, or for free.
- By sending your LinkedIn profile, you grant explicit permission for FastMath representatives to view your profile and ask for further clarification to ensure no conflict of interest is present.
You agree not to disclose information regarding FastMath identity verification procedures and outcomes to others. You agree not to make negative or disparaging statements about FastMath and/or the identity verification process, or FastMath course materials. You agree that you will keep all communications between FastMath representatives and yourself confidential, and will not disclose them to others verbally, in writing, or through electronic means, including, but not limited to, posting on Social Media, Internet message boards, or electronic messaging applications. - Artificial Intelligence training: As the FastMath materials are Proprietary and Confidential, you agree not to include any FastMath materials in training data for any computer system or program, Artificial Intelligence system, Machine Learning system, or Neural Network, and you agree not to be in the process of developing a software or Artificial Intelligence system for math and/or science education and agree not to provide FastMath materials to any such computer system or to any person or persons, entity, non-profit, business, or government which is doing so.
Copyright Protection
- You agree that all previously listed, aspects, and properties of the Course Materials, including videos, and other documents, that are not already in the public domain, are protected by US and International Copyright law and are the sole Intellectual Property of Fast Education Group, LLC or Matthew Tambiah.
- You agree not to copy, distribute or communicate information, methods, processes, or systems taught in the Course Materials, in any format or medium, either electronically or physically. Printouts of documents may be made for personal use only — such printouts may not be redistributed in electronic of physical form.
License for Personal Use Only of Course Contents and Materials
- You acknowledge that Registering of this course grants you a personal license which authorizes you to consume, view, and use the Course Materials for personal use only. You are not authorized to, and you agree not to replicate, copy, or distribute any portion of Course Materials to others; you may not, and you agree not to communicate any portion of the Course Content and/or Materials to others in written, verbal, visual, or graphical format either physically or electronically. You agree not publish or communicate any portion of the Course Content and/or Materials in any medium in a public or private forum including, but not limited to, a web site, webinar, video or audio stream or media file, blog or Internet forum post lecture, workshop, conference, presentation, or lesson beyond what is covered by personal use (e.g. viewing by one or two family and/or friends). Doing so constitutes a “Public Performance” of the Course Contents and Materials and therefore constitutes a violation of these Terms of Service will make you liable for damages of $10 Million plus the cost of attorneys fees. You must ensure that anybody who accesses or views the Course Materials under your personal license reads and is aware of the FastMath Intellectual Property Statement and Terms of Service. You may not create derivative works of the Course Materials.
Registration and Identity Verification
- Fast Education Group, LLC reserves the right to require additional information as part of the Registration and Identity Verification process and to decline requests for registrations if Users refuse to submit additional information. The information FastMath may require the User to submit includes, but is not limited to a government issued photo ID, proof of citizenship or residence, proof of enrollment in a school or university, and/or proof a User received a degree from a University.
- Registration requests from Users who have not paid for an Advanced FastMath course will be processed based on availability of resources.
- FastMath reserves the right to recall any privileges granted through Registration or access to exclusive content for Registered Users if there is any suspicious activity associated with the User or if FastMath has reason to believe the User is engaged in suspicious activity.
- FastMath reserves the right to recall any privileges granted through Registration or access to exclusive content for Registered Users if it is found that the User submitted false information as part of the Registration and Identity Verification process.
Disclaimer
User accepts that information is provided AS IS and that FastMath makes no guarantee that users will obtain a job through using the FastMath resources or improve their mental math or calculation skills. User agrees that they shall not seek damages from Fast Education Group, LLC if the User believes the FastMath resources did not lead to a significant improvement. Refunds are available via the FastMath Refund Policy or the Refund Policy for individual courses.
User acknowledges and accepts that typos, spelling mistakes, and math mistakes are not sufficient grounds to request a refund.
Violations
Violating these Terms of Service by using the Course Materials to promote a commercial offering, create another commercial offering, sharing Course Materials, or disclosing Course Materials to a third-party who then uses Course Materials to either create or promote a commercial offering will make you liable for damages, lost Revenue, and legal expenses. If you want to share FastMath with others, tell them to sign up for FastMath.
Legal
You agree that these Terms and Conditions of Use shall be interpreted under and governed by the laws of the State of Massachusetts (United States) excluding any laws that might direct the application of the laws of another jurisdiction. You waive all rights, if any, arising under the United Nations Convention on Contracts for the International Sale of Goods, and all rights of application or appeal, if any, to non-U.S. courts in connection with any question of law. Except as set forth herein, all claims, disputes and actions of any kind arising out of or relating to this Agreement (“Disputes”) shall be settled exclusively in Massachusetts (unless otherwise agreed by Fast Education Group) and you agree to submit to such jurisdiction.
If you are an European Union citizen or resident, note that we do retain your name and contact information in order to enforce the Confidentiality Agreement which is a permitted use of personal data under GDRP (enforcement of legal rights), even if you ask to have your personal information deleted. By accepting the Terms of Service, you acknowledge that Fast Education Group will retain sufficient information to enforce our legal rights.
Conclusion
By accepting the Terms of Service, you agree to all of the provisions in this Terms of Service. You willingly accept such provisions, and assert your ability to competently enter into a contract.
